DISCOVERY CONFERENCES

AND DISCOVERY

 

Each Judge in this district has a unique method for handling discovery disputes and the method seems to evolve from time to time.  Normally the case Scheduling Order will set the protocol.  As mentioned earlier on the section related to The Rule 16 Scheduling Conference, it is helpful to plan for one or two discovery conferences in the case Scheduling Order to review discovery issues with the Judge.  We find that many disputes are resolved as a result of a pending discovery conference.  If no discovery conference is required, because no disputes exist, the Judges are generally very pleased to cancel the conference.  The discovery dispute resolution procedures for certain judges can be found to the right.
